Terms of Service

Effective August 29, 2026 · version 2026-08-29. These Terms govern business and commercial website services provided under the Made by Auren brand by Faris Akroush. The project-specific checkout summary, approved change orders, Service Policy, Privacy Policy, and Acceptable Use Policy are incorporated into these Terms.

1. Authority and commercial use

Services are offered primarily for business, professional, and commercial use. The person accepting a project represents that they are at least 18, have authority to bind the identified customer, and supplied accurate customer and billing information. A personal or household purchase may carry rights that cannot be waived by these Terms.

2. Preview, quote, and accepted scope

The initial preview is free, uses exactly one image supplied by the customer, and demonstrates a design direction rather than the completed website. The confirmed checkout summary identifies the project price, amount due now, final setup balance, monthly service, pages, features, service option, delivery target, revision allowance, support, domain route, source-code option, and any technical review. Only that summary and later written change orders are included.

3. Staged payments

Unless the checkout summary says otherwise, 50% of the setup price is charged at activation and any rush fee is charged in full. The remaining setup balance is eligible for collection only after the required final quality check, delivery notice, and any displayed notice period. The recurring hosting and service charge begins only when the customer accepts the website for launch. The customer authorizes Stripe to save the selected payment method and Made by Auren to collect the exact staged and recurring amounts affirmatively accepted at checkout.

4. Tester passes

A limited tester pass waives only the exact setup amount shown at checkout. It does not waive rush priority, registrar costs, third-party costs, source-code buyout, customer-merchant costs, or monthly service unless expressly stated. Tester projects receive the same scope, publication gate, support boundary, cancellation tools, and safety review as paid setup projects.

5. Cancellation and refunds

The preview is free. After activation, a setup payment compensates Made by Auren for reserved capacity and completed production work. If a customer cancels before delivery, Made by Auren will compare the objective work completed, committed third-party costs, and approved milestones against the amount collected. Completed custom work, used rush priority, registrar charges, and committed third-party costs are non-refundable to the extent permitted by law. After the completed website is delivered, reviewed, and approved, the full setup amount is due. Refunds are provided when required by law or when Made by Auren cannot deliver the purchased scope after a reasonable opportunity to cure. This section does not limit rights that cannot lawfully be limited.

6. Customer responsibilities and start date

Work begins after payment or a valid invitation-code activation and completion of the required page plan, images, facts, policies, access, and decisions. The delivery clock starts only when those materials are complete. Missing materials, delayed approvals, inaccessible accounts, scope changes, domain restrictions, and independent service delays extend the schedule.

7. Delivery and review

Standard delivery is a target of fewer than 30 calendar days after all requirements are complete, subject to capacity, scope, customer response time, and independent providers. Rush priority adds the displayed fee and targets seven calendar days under the same conditions. These are service targets, not guarantees of a particular launch date. Every finished website receives a recorded human quality review before customer delivery; this is quality assurance, not legal, tax, accessibility-certification, or professional-advice review.

8. Revisions and new work

Minor revisions include limited corrections to approved copy, contact details, customer-approved images, spacing, colors, or similar presentation that do not change structure or functionality. New pages, sections, databases, payment flows, integrations, account systems, major redesigns, replacement functionality, or work outside the accepted scope requires a written change order and added price.

9. Domains

The customer must own or control a domain before purchase. Connection is included when the customer retains the registrar and supplies the required DNS cooperation. If the customer selects Made by Auren transfer coordination, the displayed $49 covers coordination and first-year management only; registrar transfer and renewal costs are separate. Any later management or renewal charge must be disclosed and accepted before billing. The customer remains the domain owner unless a separate signed agreement states otherwise.

10. Hosting, renewal, and online cancellation

The displayed monthly service includes hosting, HTTPS, routine platform maintenance, automated security review, always-available online assistance, and personal ticket follow-up when needed. It renews monthly until cancelled. Customers may cancel online through the billing portal without calling or speaking to a representative. Cancellation stops future renewal according to the portal effective date, takes the site offline, and does not reverse valid setup work already completed. Material price changes receive advance notice and an opportunity to cancel before the new price applies.

11. Site license, archive, and source-code option

The customer owns its domain and customer-supplied content. While monthly service is active, the customer receives a nonexclusive license to use the completed site on Made by Auren hosting. Made by Auren retains its platform, AI systems, preview engine, deployment systems, reusable libraries, and shared components. After cancellation, the site is offline and normally restorable for 180 days, with reminders near 30, 7, and 1 day before expiry. A customer-specific content archive may then be retained for up to 12 additional months and deleted, subject to billing, dispute, tax, security, and legal duties. A portable customer-specific source and transfer package may be purchased at the project price shown in the quote or dashboard, beginning at $1,250; it excludes Made by Auren’s platform, private automation, shared proprietary systems, and nontransferable licenses.

12. Customer content, intellectual property, and references

The customer represents that it owns or has permission to use submitted text, images, logos, data, reviews, and other materials and that instructions do not infringe another person’s rights. Reference websites communicate preferences only and may not be copied. Made by Auren may remove or disable disputed material while a claim is reviewed. Copyright notices may be submitted under the Copyright Policy.

13. AI-assisted work and customer verification

AI may assist with strategy, copy, layout, implementation, translation drafts, security triage, and support. Automated checks and a final quality check reduce errors but do not replace customer verification. The customer must approve business facts, prices, product claims, professional or regulated statements, policies, translations, and legal disclosures before launch.

14. Customer-site data

When customer websites collect inquiries, appointments, wholesale details, subscribers, analytics, purchases, or memberships, the customer determines the business purpose and is responsible for its visitor-facing notices and lawful instructions. Made by Auren processes that information to provide the hosted tools. The Data Processing Addendum applies where Made by Auren acts as the customer’s processor or service provider.

15. Customer storefronts and memberships

A connected customer business—not Made by Auren—is merchant of record for its visitor transactions and is responsible for its goods, services, permits, taxes, prices, fulfillment, customer service, returns, refunds, chargebacks, recurring terms, and legally required disclosures. Stripe processes payment. Commerce and membership tools remain unavailable until the merchant completes onboarding and the launch gates. The Connected Merchant Terms apply to those tools.

16. Support and emergencies

Automated online assistance is available at all times. Personal follow-up is provided by ticket, email, or support chat when needed; live phone support is not included. Emergency handling covers a Made by Auren service problem materially affecting a paid live website, not nonpayment, customer action, expired domains, unauthorized changes, or independent outages.

17. Acceptable use and suspension

The service may not be used for unlawful activity, infringement, fraud, malware, deceptive impersonation, harassment, unauthorized data collection, prohibited products, or attempts to bypass security or feature gates. Made by Auren may reject a project, remove content, or suspend service when reasonably necessary to address illegality, credible infringement, platform security, nonpayment, or a material policy breach. When practical and lawful, the customer receives notice and a chance to cure.

18. Service disclaimer

Except for promises expressly written in the accepted scope, services are provided “as is” and “as available” to the maximum extent permitted by law. Made by Auren does not promise uninterrupted operation, search ranking, sales, revenue, legal compliance, accessibility certification, or compatibility with every independent service. Nothing in these Terms excludes a warranty or remedy that applicable law does not allow the parties to exclude.

19. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, consequential, or lost-profit damages. Made by Auren’s aggregate liability for the affected project is limited to the setup and recurring fees paid for that project during the twelve months before the event giving rise to the claim. These limits do not apply to fraud, willful misconduct, infringement obligations, payment obligations, or other liability that cannot lawfully be limited.

20. Customer responsibility for third-party claims

To the extent permitted by law, the customer will defend and reimburse Made by Auren from a third-party claim caused by customer-supplied content, unlawful goods or services, the customer’s violation of law, or instructions that violate another person’s rights, except to the extent the claim was caused by Made by Auren’s own breach, negligence, fraud, or willful misconduct. Made by Auren will provide reasonable notice and cooperation and will not settle a claim imposing nonmonetary obligations on the customer without consent.

21. Independent providers and events outside control

Hosting, database, authentication, AI, payments, email, domains, carriers, and networks may experience independent interruptions or policy changes. Neither party is responsible for delay caused by events beyond reasonable control, provided the affected party takes reasonable steps to limit and resume performance. Payment obligations for work already completed are not excused.

22. General terms

California law governs, without regard to conflict rules. Any court proceeding must be brought in a court with jurisdiction in Kern County, California, unless applicable law requires otherwise. If a provision is unenforceable, the remainder remains effective. Failure to enforce a term is not a waiver. The customer may not assign the project without written consent, except with a bona fide transfer of the customer’s business; Made by Auren may assign to a successor that assumes these obligations. The accepted checkout summary, these Terms, incorporated policies, and written change orders are the complete agreement for the project. Sections that logically continue after termination—including payments, ownership, confidentiality, disputes, liability, and archives—survive.

23. Changes and notices

Material changes are posted with a new effective date and are not retroactively applied to a completed setup purchase. Changes to an active recurring service are communicated through the account email or dashboard when required.
